Pro Bono Opportunity in Case No. 3:20cv5591/MCR/EMT

This is a notice of an opportunity to provide pro bono representation in the case of Baez v. Daniels, et al., Case No. 3:20cv5591/MCR/EMT.

Plaintiff is an inmate of the Florida Department of Corrections, currently housed at Dade Correctional Institution. Plaintiff seeks relief under 42 U.S.C. § 1983 against five correctional officers at Santa Rosa Correctional Institution for alleged uses of excessive force on June 27, 2019, and August 13, 2019 (see ECF No. 18). Plaintiff also seeks relief against two medical providers who allegedly were present during the first use of force but failed to intervene, and a third medical provider who allegedly exhibited deliberate indifferent to Plaintiff’s need for medical treatment for the injuries he suffered as a result of the first use of force. Plaintiff seeks injunctive relief and compensatory and punitive damages.

All but one Defendant has appeared in this case. The court has been unable to locate one of the medical providers (Defendant Nurse Shirah). A scheduling order has been issued (ECF No. 40). The current discovery deadline is March 1, 2021, and the dispositive motions deadline is March 22, 2021. Those deadlines will be extended if counsel appears for Plaintiff and requests an extension.

Public funds are not available for the payment of attorney fees. Fees may be recoverable under applicable law if Plaintiff ultimately prevails. See 42 U.S.C. §2000e; Christiansburg Garment Co. v. Equal Emp’t Opportunity Comm’n, 434 U.S. 412, 417, 98 S. Ct. 694, 54 L. Ed. 2d 648 (1978). Limited funds are sometimes available from the District’s Bench and Bar Fund for the payment of out-of-pocket expenses incurred by an attorney providing representation of this type.

Members of the District’s bar will be afforded access to the electronic docket without charge for the purpose of considering whether to undertake the representation. An attorney who wishes to provide representation may contact the clerk’s office to obtain Plaintiff’s contact information and may enter the case by filing a notice of appearance.
