Plaintiff is an inmate of the Florida Department of Corrections proceeding pro se and in forma pauperis in this civil rights action. Presently before the Court is Plaintiff’s Motion for Appointment of Counsel. (Doc. 81).
The Court denied Plaintiff’s previous motions for appointment of counsel (Docs. 26, 55). Since that time, there has been a material change in circumstances. The case is heading for trial, and Defendants have been slow in providing Plaintiff with discovery. Plaintiff has requested the appointment of counsel to assist him in preparing for trial. (Id. at 2). He states that his close management custody status significantly limits his access to resources needed to prepare. (Id.). He also states that trial will involve conflicting testimony that will require the skill of counsel to present evidence and cross-examine witnesses. (Id.).
